Allocation Of Parental Responsibilities And Parenting Time

Child custody can be allocated in a number of ways, with parenting responsibilities shared equally or set according to specific factors affecting the child’s well-being. Most people are familiar with sole custody and joint custody, but custodial rights can be further divided into:

  • Legal custody, or the power to make decisions about the child’s education, health care and religion; in Illinois, this is now called “allocation of parental responsibilities”
  • Residential custody, or the actual living arrangements of the child and the rights and responsibilities associated with daily child care

Visitation, which, in Illinois, is now generally named “parenting time,” can be awarded to noncustodial parents and sometimes to grandparents or other family members. A visitation schedule will be set to govern the terms of visitation, including how often the noncustodial parent or family member can see the child.
